Brasilia_ The Federal Regional Court of the Fourth Region (TRF-4), in Porto Alegre, unanimously rejected today the appeal presented by the defense of former President Luiz Inácio Lula da Silva, Prensa Latina reports. Â
Without oral support by the defense lawyers or those of the prosecution, the trial was brief and was just worth to ratify the sentence to 12 years and one month in prison taken there against the former dignitary in January, and whose execution should occur once the resources in that instance were exhausted.
Even though the defense of the founder of the Workers' Party could hardly ask for clarifications (and in fact questioned 23 omissions in the sanction imposed on the ex-ruler), they nonetheless came to claim that the process was decreed null and Lula acquitted.
Now the TRF-4 has a period of 10 days to notify federal judge Sergio Moro -who in June of last year condemned Lula in the first instance- his rejection of the so-called declarations of defense presented by the latter.
Moro will then be in charge of delivering the arrest warrant, for the time being unable to be carried out until at least April 4 by decision of the Supreme Federal Court (STF).
Last Thursday, the STF decided by majority vote to grant a safe conduct to Lula allowing him to wait in freedom for the habeas corpus preventive decision requested by the defense of the former president to avoid his imprisonment until exhausting all resources in all higher judicial instances .
As announced by the president of the Supreme Court, Minister Carmen Lúcia, the merit trial of the claim will not be examined until next April 4.
The decision of the STF was considered by analysts as a partial victory for Lula, although the defense of the former dignitary said they expected a "war operation, even with complaints in the media" by those seeking to ensure the imprison of the former president.
The attack would aim to shoot down the votes (of the STF ministers) with the hope of ensuring that he is imprisoned and silenced in 2018, the columnist for the digital newspaper Brasil 247 Paulo Moreira Leite said.
Even if it is only an interim decision, the beneficial impact of the result in the Supreme Federal Court for democratic guarantees and Brazilian democracy is undeniable, with influence on the fate of much of the political map of 2018, he said.
